Assam Assembly Passes Prohibition of Polygamy Bill, 2025

The Assam Legislative Assembly on 27 November passed the Assam Prohibition of Polygamy Bill, 2025, aimed at prohibiting and eliminating the practice of polygamy in the state. The bill prescribes strict penalties, including up to 10 years’ imprisonment for contracting a second marriage.

• Scope and Applicability
The legislation will apply across all of Assam, except:

  • Sixth Schedule areas, and
  • Members of Scheduled Tribes as defined under Article 366(25) read with Article 342 of the Constitution.

• Punishment Structure Under the Bill
The proposed penalties include:

  • Up to 7 years’ imprisonment for unlawful polygamy
  • Up to 10 years’ imprisonment for concealing a previous marriage
  • Stricter punishment for repeated offences involving violence

• Protection and Compensation for Affected Women
The bill provides legal safeguards for women in illegal marriages, ensuring:

  • Right to compensation
  • Legal protection
  • Provisions aimed at safeguarding dignity and preventing exploitation

• Aim of the Legislation
The Act seeks to curb polygamous practices and address associated social challenges, marking a significant step toward ensuring women’s rights, legal clarity, and social reform in Assam.
