Key Highlights of the Bill

  • The Constitution (One Hundred and Thirtieth Amendment) Bill, 2025 seeks to amend Article 75, which deals with the appointment and responsibilities of the Council of Ministers, including the Prime Minister.
  • Provision introduced: Any minister who remains in jail for 30 days for a serious offence will automatically lose their post.
  • Such a minister can be re-appointed once released on bail.

Specific Provisions

  • The accused politician must secure bail within 30 days of arrest to retain their ministerial position.
  • On the 31st day, if bail is not granted:
    • At the Centre → the Prime Minister is required to remove the minister.
    • In the States → the Chief Minister is required to take action.
  • If not removed, the minister becomes automatically legally disqualified from functioning.
  • Once granted bail later, the leader may resume their ministerial role.

Role of the Joint Parliamentary Committee (JPC)

  • A 31-member JPC has been constituted to examine the Bill.
  • Members will be chosen by the Lok Sabha Speaker and the Rajya Sabha Chairman.
  • The JPC is a temporary body, formed for a special purpose (e.g., scrutiny of a Bill/subject).
  • JPC recommendations carry persuasive value but are not binding on the government.
