What are Execution Petitions?

The Supreme Court described the state of execution of court decrees in lower courts as “highly disappointing” in an order dated October 16, 2025, noting that litigants often wait years even after winning cases.

Key Highlights:

  • Apex Court Observation:
  • Pending Execution Petitions:
Nationwide data shows over 8.82 lakh execution petitions pending across district courts, with nearly 47.2% filed before 2020, indicating significant backlogs in enforcement.
  • Execution Petition – Final Stage of Civil Litigation:
    • After a civil suit concludes, courts issue a decree declaring parties’ rights and liabilities.
    • An execution petition is filed to enforce the decree, such as payment of money or vacation of property.
    • While an average civil suit takes about 4.91 years, an execution petition adds another 3.97 years, per National Judicial Data Grid (NJDG).
  • Previous Supreme Court Directions:
In 2021, a three-judge bench led by then CJI SA Bobde issued 14 mandatory directions, including a six-month deadline for disposal of execution proceedings, yet compliance remains poor.
  • Significance:
Delays in execution erode public confidence in the justice system, prolong disputes, and undermine the principle that “justice delayed is justice denied.”
