Centre notifies appointment of 30 judges in High Courts

The Government of India has notified the appointment of 30 judges to the High Courts of Madras, Calcutta, Madhya Pradesh and Karnataka.

The Madras High Court received the largest share of the newly appointed judges.

According to the Ministry of Law and Justice, the appointments comprise 20 advocates and 10 judicial officers.

Appointment of judges procedures

The appointment of judges to the Supreme Court and High Courts is governed by Articles 124, 217 and 224 of the Constitution of India.

The appointments follow the Memorandum of Procedure (MoP) formulated in 1998 pursuant to the Supreme Court’s Second Judges Case (1993) and the Third Judges Case (1998).

Under the MoP, the Chief Justice of India (CJI) initiates proposals for the appointment of judges to the Supreme Court.

For appointments to a High Court, the proposal is initiated by the Chief Justice of the concerned High Court in consultation with the two senior-most puisne judges of that High Court.

High Courts are required to send recommendations at least six months before a vacancy is expected to arise.

For High Court appointments, the views of the concerned State Government are obtained in accordance with the MoP.

The recommendations are also examined in light of other relevant reports and inputs available to the Government regarding the candidates.

The recommendations of the High Court Collegium, State Governments and the Central Government are subsequently placed before the Supreme Court Collegium (SCC) for its advice.

The appointment process thus involves multiple constitutional and institutional stages, with the Collegium system playing a central role in judicial appointments.
