Paid Holiday for Voters on Poll Day Mandated

The Election Commission of India has reiterated that all eligible voters employed in various sectors must be granted a paid holiday on the day of polling.

As per Section 135B of the Representation of the People Act, 1951, every individual working in businesses, trade establishments, industries, or any other organization, and entitled to vote in elections to the Lok Sabha or State/UT Legislative Assemblies, including by-elections, is eligible for this provision. Importantly, no deduction in wages is allowed for such leave.

The Commission has clarified that this benefit extends to daily wage and casual workers as well. Employers who fail to comply with the provision may face penalties in the form of fines.

Additionally, voters working outside their registered constituency—such as those employed in industrial or commercial establishments—are also entitled to a paid holiday to travel and cast their vote.

The Election Commission has directed all State and Union Territory governments to issue necessary instructions to ensure strict compliance, enabling all citizens to exercise their democratic right freely and without inconvenience.
